Appeal Court Acquits, Discharges Nnamdi Kanu
The Appeal Court in Abuja has acquitted and discharged the leader of the Indigenous Peoples of Biafra (IPOB), Nnamdi Kanu of terrorism charges.
The Court, on Thursday, upheld the appeal of the detained lPOB leader, Kanu that it was illegal for the Federal Government to have abducted him from Kenya to Nigeria.
In the final judgement, the court nullified the entire terrorism charges brought against him by the Federal Government.
It further held that the Federal Government breached all local and international laws in the forceful rendition of Kanu to Nigeria, thereby making the terrorism charges against him incompetent and unlawful.
The judgement was delivered by Justice Oludotun Adefope-Okojie. He said the criminal charges by the Federal Government against Kanu were voided and set aside.
According to the court, laws were meant to be obeyed and the Federal Government had no reason to have taken laws into its own hand in the illegal and unlawful way the matter of Kanu was handled.
The court stated that by engaging in utter unlawful and illegal acts and in breach of its own laws in the instant matter, the Federal Government did not come to equity in clean hands and must be called to order.
The court added that with appalling disregard for local and international laws, the Federal government had lost the right to put the appellant on trial for any offence.
It stated that treaties and protocols were meant to be obeyed and that no government in the world was permitted to abduct anybody without following due process of extradition.
The court said Nigeria is not an exception or excused and that Nigeria must obey her own law and that of international, so as to avoid anarchy.
